This Liability Waiver and Assumption of Risk (the “Waiver”) is entered into by the undersigned participant (the “Participant”) in connection with participation in an event, activity or experience facilitated or organised by Quintet Private Bank (Europe) S.A. (“Quintet”) (including its affiliates) (the “Event”).
1. Assumption of Risk
The Participant acknowledges and agrees that participation in the Event may involve inherent risks, including but not limited to physical injury, illness, property damage, or other loss. The Participant voluntarily chooses to participate in the Event with full knowledge and acceptance of such risks.
2. Release and Waiver of Liability
To the fullest extent permitted by applicable law, the Participant hereby irrevocably waives, releases and discharges Quintet, its affiliates, and their respective directors, officers, employees, agents and representatives from any and all claims, liabilities, damages, losses, costs or expenses of any kind (including legal fees), whether arising in contract, tort (including negligence) or otherwise, that may arise out of or in connection with the Participant’s attendance at or participation in the Event.
3. Indemnity
The Participant agrees to indemnify and hold harmless Quintet and its affiliates from and against any claims, losses, damages, liabilities or expenses (including reasonable legal fees) arising out of or related to the Participant’s participation in the Event, including any breach of this Waiver.
4. No Liability for Third Parties
The Participant acknowledges that Quintet may engage third party service providers in connection with the Event and agrees that Quintet shall not be liable for any acts or omissions of such third parties.
5. Medical Fitness
The Participant confirms that they are medically fit to participate in the Event and assumes full responsibility for any medical condition or injury that may arise during or after the Event.
6. Insurance
The Participant acknowledges that Quintet does not provide insurance coverage for the Participant in connection with the Event and that the Participant is responsible for obtaining any insurance coverage deemed necessary.
7. Governing Law and Jurisdiction
This Waiver shall be governed by and construed in accordance with the laws of Luxembourg, and the courts of Luxembourg shall have exclusive jurisdiction.
8. Severability
If any provision of this Waiver is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
